GENERAL TERMS AND CONDITIONS OF SALE (GTC) — HUGUETTE PARIS

1. PURPOSE These general terms and conditions of sale ("GTC") govern sales made by HUGUETTE COMPANY, SARL registered with the RCS of Paris under number 903 122 059, whose registered office is located at 48 rue Basfroi, 75011 Paris ("Huguette Paris"), via its website www.huguetteparis.com ("the Site").
They apply to all purchases of jewelry by consumer clients, natural persons of legal age and capacity ("the Client").
2. PRODUCTS The essential characteristics of the products are indicated in each product description. Some items are manufactured outside of France and outside the EU. If in doubt, the Customer can contact customer service.
3. PRICES Prices are quoted in euros, inclusive of all taxes (including VAT), excluding shipping and customs duties outside the EU. Customs duties and other taxes are the responsibility of the Customer. Huguette Paris reserves the right to change its prices at any time, without prior notice, particularly in the event of tax or economic changes. The applicable prices are those displayed at the time of the order.
4. ORDER The order is validated once payment is accepted and a confirmation email is sent. Huguette Paris reserves the right to refuse any non-compliant order or any order involving a prior dispute. Any fraudulent order, or one suspected of being fraudulent, will be considered null and void.
5. PAYMENT Payment is made by credit card via a secure platform provided by Stripe, which encrypts bank details and ensures safe, fast payment compliant with international security standards (PCI-DSS). Products remain the property of Huguette Paris until full payment is received. No discount will be given for early payment. Any order not paid within 7 days may be cancelled by Huguette Paris.

Tracked letter (only for small orders).
Delivery times are approximate. Huguette Paris ships orders within 24-72 business hours. Tracked letter deliveries are non -refundable in case of loss , as this method is uninsured. No refund will be issued for a package marked as delivered by the carrier, even if the customer claims not to have received it.
7. RECEIPT OF PRODUCTS The Customer is required to check the contents of the package upon receipt. In case of defects or damage, they must note this on the delivery slip and contact the carrier within 3 business days. After this period, no claims for damage will be accepted. Huguette Paris reserves the right to refuse any abusive or fraudulent request.
8. RIGHT OF WITHDRAWAL In accordance with Articles L221-18 et seq. of the Consumer Code, the Customer has a period of 14 days to exercise their right of withdrawal.
Return shipping costs are the responsibility of the customer. Personalized or custom-made products are neither returnable nor refundable, except in the case of defects or non-conformity. Any return made after the legal deadline will be refused and returned to the sender at their expense.
9. GUARANTEES
9.1 Commercial Warranty : Valid for one year from the date of delivery, covers defects not related to misuse. Any work on the jewelry by an unauthorized third party automatically voids the warranty.
9.2 Legal guarantee of conformity : 2 years according to articles L217-3 et seq. of the Consumer Code.
9.3 Warranty against hidden defects : 2 years from the discovery of the defect (articles 1641 et seq. of the Civil Code).
Mandatory box — Legal guarantee of conformity :
Under the legal guarantee of conformity, the consumer:
- benefits from a period of two years from the delivery of the goods to take action;
- may choose between repair or replacement of the goods, subject to certain cost conditions provided for in Article L. 217-12 of the Consumer Code;
- is exempt from proving the existence of the lack of conformity of the goods during the two years following delivery.
The legal guarantee of conformity applies independently of any commercial guarantee that may be granted.
10. LIABILITY AND FORCE MAJEURE Huguette Paris cannot be held responsible for the non-performance of the contract in the event of force majeure, disruption or strike of postal services and means of transport.
Huguette Paris accepts no responsibility for allergic reactions related to wearing its jewelry. The materials are described on the website for each product, and it is the customer's responsibility to verify their compatibility with their skin and any sensitivities. No refunds or compensation will be offered in this regard. Huguette Paris cannot guarantee that every customer will have the same reaction and does not offer any preliminary testing.
11. INTELLECTUAL PROPERTY All Site content (products, visuals, texts, graphics, etc.) is protected by intellectual property law. Any reproduction, in whole or in part, is prohibited without prior authorization. Any attempt at infringement will be subject to legal action.
12. PROTECTION OF PERSONAL DATA Personal data is processed in accordance with the GDPR. The Customer may exercise their rights of access, rectification, or erasure by emailing contact@huguetteparis.com . See our Privacy Policy for details. Refusal to allow data processing may prevent the order from being processed.

14. APPLICABLE LAW – DISPUTES These Terms and Conditions are governed by French law. In the event of a dispute, the competent courts will be those designated according to the rules of ordinary law. Huguette Paris reserves the right to seek redress for any abusive or bad-faith proceedings.
